Research shows that the physician’s personal attributes and social characteristics have a strong association with their end-of-life decision making. Despite efforts to increase patient, family and surrogate input into EOL decision making, research shows the physician’s input to be dominant. Our research finds that physician’s social values, independent of religiosity, have a significant association with physician’s tendency to withhold or withdraw life sustaining, EOL treatments. It is suggested that physicians employ personal social values in their EOL medical coping, because they (...) have to cope with existential dilemmas posed by the mystery of death, and left unresolved by medical decision making mechanisms such as advanced directives and hospital ethics committees. We review evidence of the psychological and social costs associated with punishing. We propose that these psychological and social costs should be considered (in addition to material costs) when searching for evidence of costly punishment.

In a characteristically iconoclastic essay, “Does the State Have a Monopoly to Punish Crime?”, Douglas Husak argues that the state’s moral right to punish crime is all but self-evident while its supposed monopoly on punishment is a fiction. Husak draws this bracing conclusion from a modest, quasi-Lockean premise – that persons and other entities have a right to impose stigmatizing deprivations on those who wrong them. This premise evokes John Locke’s far stronger claim that everyone enjoys a natural right to (...) inflict potentially severe sanctions on any wrongdoer. The quasi-Lockean premise also evokes the familiar idea that all criminal wrongdoing is an attack on the broader community, and that law-breakers consequently owe a debt to society that they can repay through punishment. In this essay, I argue that the inferences Husak draws from the quasi-Lockean premise are unsound, but for reasons that reveal important lessons about the state’s right to punish crime and about the limits of what we can extract from the venerable idea that a central victim of criminal wrongdoing is the community as a whole. In Part II, I argue that the quasi-Lockean premise does not ground the state’s right to punish the kind of wrongs traditionally thought central to the criminal law, namely, wrongs perpetrated on individual human victims. In Part III, I answer Husak’s implicit challenge to describe a kind of stigmatizing deprivation – a kind of punishment – that the state alone has a right to inflict. I suggest that no entity but the state may inflict sanctions that constitute prima facie invasions of moral rights. (shrink)

Philosophers have taken little heed of the fact that people often act contrary to their better judgment not because they suffer a volitional infirmity like weakness of will or compulsion but instead because they care too little about what they judge best (they are unconcerned) or they care too much about something else (they are compromised). Unconcerned and compromised action, being varieties of akratic action that do not involve volitional infirmity, are phenomena worth examining not only in their own right (...) but also for what they reveal about the better known varieties of akratic action for which they might easily be mistaken, such as weak-willed action and action (or inaction) that stems from accidie. Unconcern and compromise also are worth examining for what they reveal about a topic beyond philosophical psychology, namely, moral and legal accountability. Forgiveness, resentment, and retributive punishment each may have less to do with what an offender (morally) believes than with what he cares about. (shrink)

In his penetrating book on the criminal culpability of children, Gideon Yaffe advances a novel theory of desert. According to the theory, the punishment you deserve for committing a given crime is the punishment the prospect of which would have led you to deliberate correctly about how to act, had that punishment been presented to you beforehand as an inevitable consequence of your committing the crime. Although fascinating and ambitious, Yaffe’s theory of desert struggles as an account of who deserves (...) what, and it falls short of explaining why and how desert is normatively significant—why and how desert matters. All observers of our legal system recognize that criminal statutes can be complex and obscure. But statutory obscurity often takes a particular form that most observers have overlooked: uncertainty about the identity of the wrong a statute aims to punish. It is not uncommon for parties to disagree about the identity of the underlying wrong even as they agree on the statute's elements. Hidden in plain sight, these unexamined disagreements underlie or exacerbate an assortment of familiar disputes—about venue, vagueness, and (...) mens rea; about DUI and statutory rape; about hate crimes, child pornography, and counterterrorism laws; about proportionality in punishment; and about the proper ambit of the criminal law. Each of these disputes may hinge on deeper disagreements about the identity of the wrong a statute aims to punish, and these deeper disagreements can be surprisingly hard to resolve, fueled as they are by the complex inner structure of our penal laws and the discretionary mechanisms of their administration. People ordinarily make sense of their own behavior and that of others by invoking concepts like belief, desire, and intention. Philosophers refer to this network of concepts and related principles as 'folk psychology.' The prevailing view of folk psychology among philosophers of mind and psychologists is that it is a proto-scientific theory whose function is to explain and predict behavior.

Prominent theories of the criminal law borrow heavily from the two leading theories of temptation—the evaluative conception of temptation, which conceives emotion and desire as essentially involving a kind of evaluation, and the mechanistic conception of temptation, which conceives emotion and desire as essentially involving felt motivation. As I explain, both conceptions of temptation are inconsistent with the possibility of akratic action, that is, action contrary to a person’s conscious better judgment. Both are inconsistent with the possibility of akratic action (...) because both are covertly inconsistent with a two-fold psychological assumption that undergirds common beliefs about human action and lies at the heart of the law of criminal responsibility: that resisting a powerful temptation is extremely difficult yet not ordinarily impossible. I reveal these inconsistencies and offer in place of the leading theories of temptation a theory of affective desire as primitive psychic attraction, an elemental psychological state typically accompanied by evaluation and motivation but not reducible to either one. I then show how this theory of desire is consistent with the possibility of akratic action, with the two-fold psychological assumption at the heart of the law of criminal responsibility, and, in particular, with the defense of provocation. This commentary highlights the observation that social motivation is usually an imprecisely specified construct. We suggest four social motivation conceptualizations across levels of analysis and explore where the target article situates among these. We then offer theoretical and practical guidance for operationalization and measurement of social motivation to support more comprehensive future research on this complex construct in the autism literature.

We propose that revenge responses are often influenced more by affective reactions than by deliberate decision making as McCullough et al. suggest. We review social psychological evidence suggesting that justice judgments and reactions may be determined more by emotions than by cognitions.

This paper aims to pay tribute to Figal’s comprehensive and innovative analysis of the artwork and beauty, while challenging both his realist position on the immediacy of meaning and his monist stance that reduces sublimity to beauty. To enquire into the origin of aesthetic feelings and sense, and thus, to break the hermeneutic circle, we first trace the origin of this reduction to the reception of Burke’s concept of the sublime by Mendelssohn and Kant. We then recur to Husserl and (...) Dufrenne to trace the origin of the sense of the feeling of sublimity in the realm of affectivity or sensuousness. This genesis takes place in passive experience, where we identify an excess of sensuous sense over categorial meaning that is constitutive of the affective sense that our bodily sensations give to hyletic material. It is argued that this sensuous excess evokes a sublime experience in the phenomenological sense, involving an affective and disruptive bodily experience and an endless process of sense formation. Affective or sensuous sense is thus an event that irreversibly affects the bodily surface. To elucidate this phenomenon, we draw on the theoretical framework of Breton and Bataille, positing it as a form-transgressive ‘convulsive’ sublime, which we then illustrate in the architectural works of Tschumi and Eisenman. In short, we have retrieved the origin of aesthetic experience and redefined the feeling of the sublime as a phenomenological ‘convulsive’ sublimity. (shrink)

The principle of universal instantiation plays a pivotal role both in the derivation of intensional paradoxes such as Prior’s paradox and Kaplan’s paradox and the debate between necessitism and contingentism. We outline a distinctively free logical approach to the intensional paradoxes and note how the free logical outlook allows one to distinguish two different, though allied themes in higher-order necessitism. We examine the costs of this solution and compare it with the more familiar ramificationist approaches to higher-order logic. Anniversary commemorations are ambivalent events, particularly when they celebrate philosophers. Such commemorations focus on a life's work and occasionally contribute to its elucidation. However, they frequently do violence to those they intend to honor, by emphasizing primarily those aspects of a thinker's work which make him acceptable to the spirit of the age. And such was the fate of Theodor Adorno, whose eightieth birthday was observed in 1983 at a major conference, held in Frankfurt, West Germany. There his interpreters, embarked (...) on the task of rediscovering, brought out important aspects and opened up new perspectives. But die heart of Adorno's work, the negative dialectic, encountered outright resistance. (shrink)

French existentialist philosopher Gabriel Marcel is one of the most influential thinkers of the twentieth century. The central themes of his philosophy, which are developed with a blend of realism, concreteness, and common sense, continue to be relevant for the plight of humanity in the twentieth-first century. Marcel's thought emphasizes: the attempt to safeguard the dignity and integrity of the human person by emphasizing the inadequacy of the materialistic life and the unavoidable human need for transcendence; the inability of (...) philosophy to capture the profundity and depth of key human experiences, and so the need to find a deeper kind of reflection; the importance of the experience of inter-subjectivity, which Marcel believes is at the root of human fulfillment, and which also finds expression in the transcendent dimension of human experience, a dimension that cannot be denied without loss, and that often gives meaning to our most profound experiences. Marcel is also one of the few contemporary thinkers who manages to do justice to the subjectivity and individuality of the human person, while avoiding the relativism and skepticism that has tended to accompany these notions, and that has plagued contemporary philosophy after Heidegger. He makes an unwavering effort to challenge the moral relativism and spiritual nihilism of his French rival, Jean-Paul Sartre, and of other representative existentialist philosophers. All of Marcel's important ideas are introduced here, ranging from his unique conception of philosophy; to his original approach to epistemology and the nature of knowledge; to his view on the nature of the human person, including the idea of being-in-a-situation and the importance of the "context" that the subject lives in for the subject's ideas and experiences; to his approach to religious themes, including the issues of the rationality of religious belief, the question of God's existence, and our longing for the transcendent; and his "concrete approaches" of fidelity, hope, love and faith. There are also selections in which he discusses some of his misgivings about the direction of contemporary culture, especially the effects of technology. This paper develops a theory of analog representation. We first argue that the mark of the analog is to be found in the nature of a representational system’s interpretation function, rather than in its vehicles or contents alone. We then develop the rulebound structure theory of analog representation, according to which analog systems are those that use interpretive rules to map syntactic structural features onto semantic structural features. The theory involves three degree-theoretic measures that capture three independent ways in which (...) a system can be more or less analog. We explain how our theory improves upon prior accounts of analog representation, provides plausible diagnoses for novel challenge cases, extends to hybrid systems that are partially analog and partially symbolic, and accounts for some of the advantages and disadvantages of representing analogically versus symbolically. BackgroundInformed consent forms are intended to facilitate research enrollment decisions. However, the technical language in institutional templates can be unfamiliar and confusing for decision-makers. Standardized language describing financial implications of participation, namely compensation for injury and costs of care associated with participating, can be complex and could be a deterrent for potential participants. This standardized language may also be misleading in the context of comparative effectiveness trials of standard care interventions, in which costs and risk of injury associated with participating (...) may not differ from regular medical care. In addition, the revised U.S. Common Rule contains a new requirement to present key information upfront; the impact of how this requirement is operationalized on comprehension and likelihood of enrollment for a given study is unknown.MethodsTwo online surveys assessed the impact of (1) changes to compensation for injury language (standard vs. tailored language form) and (2) changes to the key information page (using the tailored compensation language form with standard key information vs. modified key information vs. modified key information plus financial information) on both likelihood of enrollment in and understanding of a hypothetical comparative effectiveness trial.ResultsLikelihood of enrolling was not observed to be different between the standard and tailored language forms in Study 1 (73 vs. 75%; p = 0.6); however, the tailored language group had a higher frequency of understanding the compensation for injury process specific to the trial (25 vs. 51%; p < 0.0001). Modifications to the key information sheet in Study 2 did not affect likelihood of enrolling (88 vs. 85 vs. 85%; p = 0.6); however, understanding of randomization differed by form (44 vs. 59 vs. 46%; p = 0.002).ConclusionsThese findings suggest that refining consent forms to clarify key information and tailoring compensation for injury language to the nature of the study, especially in the context of comparative effectiveness trials, may help to improve study comprehension but may not impact enrollment. The great poets and thinkers of modernity described a situation we still inhabit today: the catastrophic undermining of all foundations, the disorienting relativization of all reference points, the prospect of abandonment to chance and contingency alone--the shipwreck of Mallarmé's Coup de dés. Instead, the "shipwreck" is to be understood as a suspension of finite subjectivity in the fullness of a "phenoumenodelic pleroma," an atonal milieu ringing with unheard-of possibilities. Announcing an ambitious program for the renewal of transcendental philosophy, in Pleromatica Catren recomposes the primary elements of modern thought into a startling new configuration, introducing a vivid constellation of new concepts with which to map out and navigate the vast space of this "worldless daydream. Apresenta uma análise preliminar das manifestações dos autores das Ciências Sociais e Humanas dentro do campo da Biblioteconomia e da Ciência da Informação (B & C.I.), por meio do método bibliométrico e análise de citação. Com o objetivo de descortinar quais teóricos são convocados para a construção do conhecimento na produção científica dos campos supracitados, realizou-se uma pesquisa exploratória com vistas ao levantamento dos autores das Ciências Sociais e Humanas e, posteriormente, a verificação da ocorrência deles na produção indexada pela (...) Base de Dados em Ciência da Informação (BRAPCI). Foram identificados 180 autores, dos quais 91 apareceram pelo menos uma vez nas buscas empreendidas pelos nomes e sobrenomes desses autores das Ciências Sociais e Humanas. O resultado desta pesquisa demonstrou os dois autores mais citados, Michel Foucault e Pierre Bourdieu, bem como a presença de diversos autores das Ciências Sociais e Humanas na construção do conhecimento da Biblioteconomia e da Ciência da Informação, o que contribui para o fortalecimento e a consolidação de ambas. According to the structured theory of propositions, if two sentences express the same proposition, then they have the same syntactic structure, with corresponding syntactic constituents expressing the same entities. A number of philosophers have recently focused attention on a powerful argument against this theory, based on a result by Bertrand Russell, which shows that the theory of structured propositions is inconsistent in higher order-logic. This paper explores a response to this argument, which involves restricting the scope of the claim that (...) propositions are structured, so that it does not hold for all propositions whatsoever, but only for those which are expressible using closed sentences of a given formal language. We call this restricted principle Closed Structure, and show that it is consistent in classical higher-order logic. As a schematic principle, the strength of Closed Structure is dependent on the chosen language. For its consistency to be philosophically significant, it also needs to be consistent in every extension of the language which the theorist of structured propositions is apt to accept. But, we go on to show, Closed Structure is in fact inconsistent in a very natural extension of the standard language of higher-order logic, which adds resources for plural talk of propositions. We conclude that this particular strategy of restricting the scope of the claim that propositions are structured is not a compelling response to the argument based on Russell’s result, though we note that for some applications, for instance to propositional attitudes, a restricted thesis in the vicinity may hold some promise. Over the last two centuries, the relationship between philosophy and science has completely broken down, so the question we are confronted with is: How can we develop a new philosophy, which will influence science decisively? The physicists of the last century rejected their contemporary philosophy. They considered that “philosophy today is dead” (Hawking and Mlodinow 2010). However, we believe that the great scientific problems are always philosophical, and only philosophical problems. Therefore, these problems can be solved only by philosophers and (...) scientists who operate at the greatest level of thinking: that of the “paradigm of thinking”. In fact, these great scientific problems can usually be solved by changing the “paradigm of thinking” for scientists. This book furnished more applications of the “epistemologically different worlds” (that replaced the “world”/”universe” – in their previous books (2008, 2010, 2011, etc.), the authors indicated that the notion of the world/universe is wrong). Following Aristotle’s “Prime Mover” (or the “Unmoved Mover”), we stop the regress ad infinitum by discovering the first EW, the EW0 (the Hypernothing). Even if one EW does not exist for any EDW, the Hypernothing was the first EW and all other EDWs correspond to the EW0. Chapter 2 is about the “Hypernothing”. The other chapters continue our works of applying the EDWs to different concepts/areas of Physics: quantum mechanics, elementary particles, thermodynamics (with its main notion, “entropy”), etc. In the last chapter, knowing that Einstein’s special and general theory of relativity are very correct (but in a book 2016 we showed that “spacetime” cannot ontologically exist), we re-write both theories without “spacetime”. The current paper synthesizes theory and data from the field of life history (LH) evolution to advance a new developmental theory of variation in human LH strategies. The theory posits that clusters of correlated LH traits (e.g., timing of puberty, age at sexual debut and first birth, parental investment strategies) lie on a slow-to-fast continuum; that harshness (externally caused levels of morbidity-mortality) and unpredictability (spatial-temporal variation in harshness) are the most fundamental environmental influences on the evolution and development of LH (...) strategies; and that these influences depend on population densities and related levels of intraspecific competition and resource scarcity, on age schedules of mortality, on the sensitivity of morbidity-mortality to the organism’s resource-allocation decisions, and on the extent to which environmental fluctuations affect individuals versus populations over short versus long timescales. These interrelated factors operate at evolutionary and developmental levels and should be distinguished because they exert distinctive effects on LH traits and are hierarchically operative in terms of primacy of influence. Although converging lines of evidence support core assumptions of the theory, many questions remain unanswered. This review demonstrates the value of applying a multilevel evolutionary-developmental approach to the analysis of a central feature of human phenotypic variation: LH strategy. (shrink)

Durkheim's underdeveloped notion of fatalism is the keystone for a bridge between two conceptual categories central to Marxian and Durkheimian theory: alienation and anomie. Durkheim does not necessarily disagree with Marx that excessive regulation can be socially damaging but chooses to highlight the effects of under- regulation. A Durkheimian critique of overregulation becomes possible if we turn away from anomie and toward Durkheim's idea of fatalism-a concept that I will argue here is unexpectedly consistent with Marx's notion of alienation. We (...) can infer that Durkheim presents us with a notion of an "optimal" human condition that exists between anomie and fatalism. The structure of modern societies, it will be argued, is characterized not just by excessive control leading to alienation or by a lack of integrative restraint leading to anomie but also by active efforts to optimally regulate social life. The author of 'Betrachtungen eines Unpolitischen' (1918) is usually regarded as one of the founding fathers of the so-called 'Conservative Revolution'. But Thomas Mann's understanding of this concept does not at all coincide with the definition established by Armin Mohler, mainly in that it is not Nietzschean. Nor do the ties with the George circle furnish grounds for assigning Mann to the 'Conservative Revol ution', any more than to the 'aesthetic fundamentalism' which was cul tivated there. Moreover, it can be (...) shown that Mann's political views differ significantly from the 'new nationalism' propagated in the circle around Arthur Moeller van den Bruck, and that they have more affini ties to old liberalism than to a 'Conservative Revolution'. Gabriel Richardson Lear presents a bold new approach to one of the enduring debates about Aristotle's Nicomachean Ethics: the controversy about whether it coherently argues that the best life for humans is one devoted to a single activity, namely philosophical contemplation. Many scholars oppose this reading because the bulk of the Ethics is devoted to various moral virtues--courage and generosity, for example--that are not in any obvious way either manifestations of philosophical contemplation or subordinated to it. They argue that (...) Aristotle was inconsistent, and that we should not try to read the entire Ethics as an attempt to flesh out the notion that the best life aims at the "monistic good" of contemplation. In defending the unity and coherence of the Ethics, Lear argues that, in Aristotle's view, we may act for the sake of an end not just by instrumentally bringing it about but also by approximating it. She then argues that, for Aristotle, the excellent rational activity of moral virtue is an approximation of theoretical contemplation. Thus, the happiest person chooses moral virtue as an approximation of contemplation in practical life. Richardson Lear bolsters this interpretation by examining three moral virtues--courage, temperance, and greatness of soul--and the way they are fine. Elegantly written and rigorously argued, this is a major contribution to our understanding of a central issue in Aristotle's moral philosophy. (shrink)

Metacognitive ability has been described as an important predictor of several processes involved in learning, including problem-solving. Although this relationship is fairly documented, little is known about the mechanisms that could modulate it. Given its relationship with both constructs, we decided to evaluate the impact of self-knowledge on PS. In addition, we inspected whether emotional and interpersonal variables could affect the relationship between metacognition and problem-solving. We tested a sample of 32 undergraduate students and used behavioural tasks and self-report questionnaires. (...) Contrary to the literature, we found no significant relationship between metacognition and problem-solving performance, nor a significant moderating effect when including emotional and interpersonal variables in the model. In contrast, we observed a significant moderating model combining metacognition, self-reported anxiety and attitudes towards social interdependence. It was found that participants with high metacognition reported attitudes unfavourable towards interdependence when they felt high anxiety. These results suggest that already anxious individuals with high metacognition would prefer to work alone rather than with others, as a coping mechanism against further anxiety derived from cooperation. We hypothesise that in anxiogenic contexts, metacognition is used as a tool to compare possible threats with one’s own skills and act accordingly, in order to maximise one’s own performance. Further studies are needed to understand how metacognition works in contexts adverse to learning. (shrink)

After a brief pseudo-renaissance following WWII, one now hears far less in legal theory about natural law, which appears finally to have fallen victim to what Weber early in the century characterized as “a progressive decomposition and relativization of all meta-legal axioms” — a destruction resulting partly “from legal rationalism itself,” and partly “from the skepticism which characterizes modern intellectual life generally.” Law (...) today, wrote Weber, “is all too tangibly (in the great majority of its determinations, and especially in many which are particularly important in terms of principle) revealed to be both the product and the technical medium of a compromise of interests,”. When I read this paragraph about her book: -/- In Form, Matter, Substance, Kathrin Koslicki develops a contemporary defence of the Aristotelian doctrine of hylomorphism. According to this approach, objects are compounds of matter (hule) and form (morphe or eidos) and a living organism is not exhausted by the body, cells, organs, tissue, and the like that compose it. Koslicki argues that a hylomorphic analysis of concrete particular objects is well equipped to compete with alternative approaches when measured against a (...) wide range of criteria of success. However, a plausible application of the doctrine of hylomorphism to the special case of concrete particular objects hinges on how hylomorphists conceive of the matter composing a concrete particular object, its form, and the hylomorphic relations which hold between a matter-form compound, its matter and its form. Koslicki offers detailed answers to the questions surrounding this approach to the metaphysics of concrete particular objects. As a result, matter-form compounds emerge as occupying the privileged ontological status traditionally associated with substances, despite their metaphysical complexity, due to their high degree of unity. Os discursos da Biblioteconomia brasileira são objeto de estudo desta pesquisa, que se concentrou nos artigos publicados durante a década de 1980 na Revista de Biblioteconomia de Brasília. Essa revista, cujo primeiro número foi publicado em 1973, encerrou suas atividades em 2001 e teve como foco as áreas de Biblioteconomia, Ciência da Informação, Arquivologia e afins. Com a intenção de discutir sobre dois conceitos centrais da Biblioteconomia - o de biblioteca e o de bibliotecário - analisamos as produções que versavam (...) sobre tais categorias de análise. A pesquisa é, então, considerada exploratória, de cunho bibliográfico, cujo método empregado foi o da análise de conteúdo. Essa década foi marcada pela importância da informação e da tecnologia como fatores responsáveis pelo desenvolvimento social e econômico do país. A biblioteca, nesse contexto de uma sociedade da informação, é marcada pela discussão da automação de seus serviços e produtos. O bibliotecário, visto como um profissional da informação, também tem um importante papel a desempenhar na sociedade, inclusive, o de estar ao lado dos mais vulneráveis. (shrink)

This paper enquires into a paradigmatic change concerning the concept of motion: from a phenomenological conception of motion understood as a continuous and finite process of translation, to a physical conception of motion as rectilinear, uniform and continuous, that is, as an inertial state that if unhindered, can extend infinitely – the former held by Aristotle, the latter by Koyré, a shift that is evidenced by their contrasting treatment of Zeno’s paradoxes. I argue that both ontologies of motion can be (...) understood in phenomenological terms: Motion is accomplished by the real itself. However, while Aristotle’s continuous motion as actualization of the form of a given body involves its formal determination and constitution of sense, Koyré’s conceives of motion and rest as kinds of being and motion itself as exemplifcation of the mathematization of nature that Husserl described in the Crisis. Taken together, these changes presuppose a transformation of metaphysical and epistemic frameworks. (shrink)

Background Deep brain stimulation is approved for treating refractory obsessive-compulsive disorder in adults under the US Food and Drug Administration Humanitarian Device Exemption, and studies have shown its efficacy in reducing symptom severity and improving quality of life. While similar deep brain stimulation treatment is available for pediatric patients with dystonia, it is not yet available for pediatric patients with obsessive-compulsive disorder, although soon could be. The prospect of growing indications for pediatric deep brain stimulation raises several ethical concerns relating (...) to bodily integrity, the ability to offer informed assent, and the role pediatric patients play in the decision-making process. Objective The aim of this study is to solicit and assess the views of stakeholders (children, parents, clinicians) on pediatric assent, autonomy, and bodily integrity in the context of potential pediatric deep brain stimulation for obsessive-compulsive disorder. Methods Semi-structured interviews were conducted with pediatric obsessive-compulsive disorder patients ( n = 21), caregivers of pediatric obsessive-compulsive disorder patients aged 14–18 ( n = 19), and clinicians with experience treating refractory obsessive-compulsive disorder ( n = 25). Interviews were transcribed and coded in MAXQDA 2018 and 2020 software and processed for thematic content analysis to isolate and compare specific themes. Results A majority of respondents (74%, 48/65) across all three stakeholder groups voiced that the decision-making process should be collaborative and involve everyone (clinicians: 84% or 21/25, caregivers 71% or 15/21, and patients 63% or 12/19). We identified a split between respondents’ views on who should have the final say in the event of disagreement (38% or 25/65 favored the patient versus 35% or 23/65 favoring caregivers). A split between respondents also emerged concerning the maturity relevant for deep brain stimulation decision-making, with 45% (29/65) favoring developmental maturity (age/physiological development) and 45% (29/65) favoring decisional maturity (capacity to understand and weigh information). A majority of clinicians indicated that they would not move forward with deep brain stimulation without securing patient assent (80% or 20/25), with some stating the only exception is if patient quality of life was very poor and/or they lacked insight. Both caregivers and patients expressed a significant respect for the patient's right to bodily integrity, with 67% of caregivers (14/21) and 68% of patients (13/19) justifying patient involvement in decision-making specifically with reference to infringements of bodily integrity. Conclusion Our findings demonstrate that despite broad agreement across stakeholders that the decision-making process for pediatric deep brain stimulation for obsessive-compulsive disorder should be collaborative and somehow involve pediatric patients, there is disagreement about what this process entails and what factors determine patient involvement in the process. However, there is agreement that children have a right to bodily and brain integrity, which should only be infringed upon in rare circumstances. (shrink)

This edition of G. E. Moore's notes taken at Wittgenstein's seminal Cambridge lectures in the early 1930s provides, for the first time, an almost verbatim record of those classes. The presentation of the notes is both accessible and faithful to their original manuscripts, and a comprehensive introduction and synoptic table of contents provide the reader with essential contextual information and summaries of the topics in each lecture. The lectures form an excellent introduction to Wittgenstein's middle-period thought, covering a broad range (...) of philosophical topics, ranging from core questions in the philosophy of language, mind, logic, and mathematics, to illuminating discussions of subjects on which Wittgenstein says very little elsewhere, including ethics, religion, aesthetics, psychoanalysis, and anthropology. The volume also includes a 1932 essay by Moore critiquing Wittgenstein's conception of grammar, together with Wittgenstein's response. Using an event-study framework, we examine the stock market reaction to the announcement of firm withdrawal from countries designated as “State Sponsors of Terrorism” by the U.S. Department of State. We find that such announcements are, on average, linked to a statistically significant increase in firm value—an effect which already kicks in a few days before the announcement date. The observed abnormal returns are positively associated with the U.S. domicile, the intensity of a firm’s hitherto existing engagement in a designated (...) country, the number of countries that it withdraws from, as well as with a withdrawal from Iran compared to a withdrawal from other countries. Evidence suggests an increase in demand for stocks of withdrawing firms as a plausible cause of the positive stock price reaction. Pension and endowment funds are significantly less likely to own strategic stakes in firms with intensive involvements in countries designated as “State Sponsors of Terrorism.” We find some statistical evidence that firms remaining active in such countries have abnormally positive returns in the long run. It addresses the question of motivation and justification or evidence for moral feelings and actions. In particular, it focuses on the emotional states of Philia and love as well as the inherent relationship between affectivity and reason. The possibility and extent of thought without language have been subject to much controversy. Insight from non- or minimally verbal humans can inform this debate empirically. Since most such individuals are on the autism spectrum, of which they make up a sizable 25–30%, an important connection between language and autism transpires. Here we propose a model which makes sense of this link and explains why the non-verbal human mind, as present evidence suggests, represents a fundamentally different cognitive phenotype. This model (...) views the relevant part of the autism spectrum as reflecting the breakdown of a cognitive phenotype of which language is an inherent element and which will manifest principled limitations in the latter's absence. Harcourt argues that in clinical contexts, children and young people with mental health illness can experience epistemic, specifically testimonial, injustice when their perspectives are unjustifiably discounted by health service providers.1 Our goal in this commentary was to illustrate how caregivers, a critical component of CYP treatment triad, can also engage in testimonial injustice towards CYP patients. Testimonial injustice occurs when one suffers a credibility deficit and that credibility deficit is based on prejudice.2 Harcourt expands Fricker’s account of testimonial injustice by (...) arguing that for CYPs, the credibility deficits attributed to them by clinicians, for example, may result from epistemic arrogance in that CYPs are viewed as having unreliable knowledge about their condition. Harcourt writes: ‘Being a CYP is treated as a heuristic for epistemic unreliability across a wide range of domains’, including clinical settings. Harcourt’s expansion of Fricker’s account thus includes epistemic arrogance as an alternative necessary condition, in addition to prejudice, to apply the concept of testimonial injustice. We think Harcourt’s argument can also be extended to caregivers, who are central to the CYP treatment triad. We illustrate how this may be the case by drawing from research we conducted to understand the perspectives of clinicians and prospective families, both caregivers and paediatric patients with obsessive–compulsive disorder about the possibility of …. This paper deals with the problem of the origin of sense and meaning. For Husserl, the determination of the ideal identity of something new can only take place retroactively in the totality of the preceding series by stepping back towards the original foundation of sense. In this regard, J. Derrida questions the ideality of the same as presence and the possibility of retrieving any arché of sense in his writings Speech and Phenomena and Edmund Husserl’s Origin of Geometry. Phenomenology is (...) not oblivious to these difficulties, as results from a closer reading of the correlation between idealities and sensory experience: It will show that there are at least four interrelated gaps in the Husserlian phenomenology which testify the difficulty in grasping a retraceable arché of sense. First, the gap between the ideality of sense and its representation. Second, the gap between sensory and categorial intuitions, whereby both exceed one another. Third, the gap between the ideality of sense and the sense which exceeds our expectations. Fourth, the gap between the experience of the new that overcomes us and its apprehension by consciousness. Hence, there is a fundamental gap between the conceptual idealities and the essential indeterminacy of our phenomenological sensory experience, which is correlative to an excess of one in respect to the other. In this sense, Derrida’s concepts of « différance » and “invention” allow us to conceive of this self-givenness of sense as the expression of its constant self-renewal. This expression takes the form of a trace, which, neither present nor absent, suspends meaning and full presence, leaving the narrative “open” for the reinvention of sense. (shrink)

This article introduces and summarizes selected papers from the first World Business Ethics Forum held in Hong Kong and Macau in November 2006, co-hosted by the Hong Kong Baptist University and by the University of Macau. Business Ethics in the East remain distinct from those in the West, but the distinctions are becoming less pronounced and the ethical traffic flows both ways.

In this article, we aim to address neoliberal rationality as a form of antidemocratic governmentality, operating through and for inequality. Subsequently, we will explore within the Argentine political theoretical tradition the possibility of delineating an alternative governmentality. To achieve this, we have divided the article into three paragraphs and a final reflection section. In the first paragraph, we seek to reconstruct Foucault's problematization of governmentality as presented in the late 1970s. In the following paragraph, we utilize Foucault's framework to elucidate (...) how the promotion of inequality and the formal reduction of democracy are interconnected from the perspective of neoliberal rationality. In the final paragraph, we explore the possibility of articulating an alternative governmentality to neoliberalism based on the way Argentine philosopher Conrado Eggers Lan problematized Peronism in the early 1970s. Finally, we propose some considerations and draw conclusions based on the intersection between Foucault and Eggers Lan's perspectives. (shrink)
